Wills, Estate Planning & Estate Disputes

Wills & EstatesWaldron Schofield adopt a holistic approach when preparing your will. At the time of making your will we will sit down with you and talk about your overall financial situation in the context of estate planning.

Good estate planning strategies can give you and your family peace of mind. Estate planning allows you to set in place provisions to secure benefits for your heirs. Our solicitors can also assist you to make appropriate provisions for minors and vulnerable beneficiaries.

We will also give you advice about how you can protect your estate from challenges.

We invite you to make an appointment if you need help with:

  • Drafting & updating your wills
  • Preparing powers of attorney, which is a document used by someone else you appoint to make financial decisions on your behalf if in the future you are unable to make these decisions yourself
  • Preparing enduring guardians which is a document used by someone else you appoint to make decisions on your behalf about your health care and living arrangements if in the future you are unable to make these decisions yourself

PROBATE

Waldron Schofield can help you apply to the Supreme Court of NSW for Probate in instances where there is a valid will and you have been nominated as Executor of that will. The Supreme Court of NSW can then grant probate which authorises you to distribute the deceased estate in accordance with the provisions of the will.

LETTERS OF ADMINISTRATION

In the event that a valid will has not been left, Waldron Schofield can assist you with applying for Letters of Administration to the Supreme Court of NSW. In these circumstances, there is legislation that details how an estate may be distributed and by whom. The Supreme Court of NSW can appoint an Administrator to distribute the estate under the Succession Act 2006.

ESTATE DISPUTES

Have you been left out of a will? Or, are you an executor where someone else is making a claim against the estate?

Waldron Schofield can assist you in either scenario. We have successfully represented many clients involved in these circumstances.

Estate disputes can be very stressful as they occur in the context of losing a loved one. That’s why it is important to have an experienced and understanding lawyer to help you through this difficult time.
